1. Just pulled the historic fare data in Amadeus. There have been no changes to the BREE fare at all. The historic fare display clearly does not list any penalty for the BREE fare.

2. If the ticket does not have any restrictions listed in the endorsement field, that's what's taking precedence over any fare rules. Because if you bought a ticket that's not advising you of any restrictions there might be - then those restrictions would not be enforceable even if they were there. (In case of the BREE fare, they are not even there).
