There should be no electronic devices on once the a/c door is closed, and not turned on again until the Flight Attendant makes the announcement to turn them back on again.
So having anything in your ears, regardless of where you're sitting, would have the Flight Attendant to ask you to put them away.
Now, the Flight Attendants who ignored proceedure and allowed you your earphones on during taxi and climb out, weren't doing their job.
