Actually, HA is suing YV over the use of proprietary information obtained during both HA and AQ's bankruptcy, something YV promised not to do for a period of two years. HA alleges that they broke this agreement. When trying to secure investors for the go! operation, HA claims that YV copied the proprietary information verbatim, then lied under oath in court regarding its use. The YV business plan, more or less, was to try to put AQ out of business, then raise their prices once they were out of the way. AQ isn't suing YV as it is believed that their case isn't as strong as that of HA's.
The consultant (Garfinkle) allegedly told YV that their plan to enter interisland was critical upon AQ going under, and wrote that by announcing their own interisland operation, it would scare off AQ's investors, hence hastening the demise of AQ. Garfinkle also determined that there was no room for a third major player on the interisland corridor, and that AQ
must go out of business in order for YV to succeed.

There were quite a few employees from the three local carriers (HA, AQ, WP) presented at the proceeding.
A decision will be made within a few weeks.........or so we think.
