During boarding, a TSA screener who appeared to be about 15 years old asked me if I would allow him to pat me down. This was after I went through the TSA checkpoint. I told him he could not pat me down because he did not have an individualized suspicion of my involvement in criminal activity, and as an attorney I know that state actors must have such suspicion in order to conduct a pat down. He had a shocked look on his face and then proceeded to violate the Fourth Amendment rights of a middle aged man who apparently was not an attorney.
You were already through the checkpoint? Why on earth would a screener want to pat you down after you have already been screened???? Or did you mean you were already through the WTMD?
