They have to modify their tariffs subject to approval by the CTA (Canadian Transportation Agency) to introduce the rule. The CTA has repeatedly said they want fuel surcharges rolled-into the fare since a surcharge should only reflect a temporary measure. It seems that the surcharge is no longer temporary although it is certainly variable.
