I think it was Delta who were sued twice over this:

Once from an obese pax who was forced to buy two seats as he could not fit into one and a second case from a pax who was forced to sit next to an obese pax and was thus squeezed into his seat.

I don't know how it ended ? Perhaps this was the reason for chapter 11...
