The point is that there is a standard that wasn't met.

Whatever the standard is, 150%, 200%, the standard has to be met. The recognized way to meet that test is to actually snap the wing and see what it does. As you say, the 777 wing PASSED THE TEST and snapped at 153% of ultimate load. The A380 on the other hand FAILED THE TEST. What should happen is that the redesigned wing should be subject to the same test and see where it fails. If they can't get it right then the plane should not be certified to fly.
