By the way your alias Flying Lawyer, are you really a lawyer and if yes, would you be interested in such a real case ? My location 80km from DUS 40km from CGN think not to far from you.

I am not sure that a German court would hold this. The AG Köln decisions refer to unused out- or inbound flights. You suggest to "miss" only a part of your outbound flight. As it would be very obvious that you - living in Germany - "missed" parts of the flight (or even never travelled to TIP) to get a cheaper fare, I see some likelyness that a court would understand this as abusive.
