100% correct. I said this in my original reply. Some companies (including a large UK Bank) circumvent the rules by making a "service" call (for quite spurious reasons) and then get the customer to agree to opt-in for a sales call. It works well for them, although it does push aquisition costs up.
I am TPS registered and have been since it was introduced. However, I have no issue with companies that I have a relationship with calling me to discuss something that may be beneficial.
