You say that because you are an SE. If I book an M fare for a flight a month away and confirm my upgrade now, and you book an H fare planning to upgrade a week out, who do you think AC would rather upgrade? They make the rules, so I'm going to assume they'd rather have me on an M fare. If they would prefer to have you in J, then they would let you confirm at booking as well. The whole point of offering Y and M fares is so that status pax can avoid the aerolotto, meanwhile AC can get more money from us. I really don't see any situation in which someone who confirmed their upgrade more than a week out would be downgraded as there are often many J seats still open when the SE window opens up.
