I just do not see this as fair, aybody else agree?

No. BA is giving you miles as a goodwill/PR gesture. Bottom line the only action which they are required to do is get you from point A to point B. If they fail in that effort they are required by law to compensate you, but they have not obligation to compensate you for the lack of Perrier Jouet, Johnny Walker Blue and Canapes. Though at the time you (and I for that matter)might think so!
