I don't know...I agree with
dnw on this one. I'm sure these words
are cynically used to try and sneak out of such regulations when delays are in fact within an airline's control...but this is really not BA's fault at all IMHO. I'd imagine there's probably some standard legal test (e.g. like when establishing the damages which count as arising from 'reasonably foreseeable' events in tort law - God it's ages since I looked at law, I'm sure one of the actual lawyers here can jump in!). Either way, I can't see how a wildcat strike by GG was reasonably foreseeable by BA in the first place, let alone any ridiculous, illegal sympathy action from their own employees just because they share a union? Awful for the passengers, but also an impossible situation for BA and not BA's job to compensate here IMHO. Some kind of class action against GG would be more just...but that would no doubt kill the company for good...which may be no bad thing after this shambles!
I feel thankful that for the first time in as long as I can remember I've got nothing in MMB at the moment! I feel very sorry for everyone caught up in this - and let's not forget it affects inbound flights too now so that's 10,000s of people scattered over the globe

A truly appalling state of affairs that I can't believe is happening in the 21st century!
