"K", an LY FF booked a flight to NYC in seat 34Beconomy class. after 3 hrs. flying one of the FA's asked him to move to a different seat, 45K. soon "K" realized that the new seat, adjacent to the emergency exit, will only allow him sitting at 45 degrees.

after falling asleep w/his foot on the emergency slide, one of the FA's woke "K" up & asked him to lower his legs. whe he complained he could not sit in any other way, she threatened she would have the police await him when they arrive in NYC. when he asked to move to another seat she informed him that economy was full up & he could pay 929$ & move to Business class. (which he ended up doing).

w/his return to Israel, "K" sued LY for 8,000 NIS, claiming that the FA's were impertinent & offensive in the way they treated him. LY claimed in their defense that the emergency exit does not disturb the comfot of the seat.

the Judge that heard the testimonies of both sides decided the suit was justified & awarded 6,000 NIS + 2,000 NIS for court costs.
explaining his decision the judge wrote that the testimony of "K" was credible. it was proven that the reserved seat for him was indeed 34B.
