The person was shooting, now he is dead, for it was his shooting that he is no more. Had he not been shooting at the police, he would be alive, but what is, is, and what was, was. I could have used had been, but was, was obviously before he died; you probably understood what was meant, unless you don't even understand what the definition of is, is.
