Generally it is. In the end, the the guy was clearly oblivious, as opposed to necessarily rude. The best solution would have been for one of the sleeping (or trying to, anyway) parties to bring the situation (politely) to the attention of Jackass J. If he had then continued, and not taken advantage of open, non-intrusive space...that would have been rude.
