Sure...everything in life is a risk. BUT...we are talking about negligence here on the part of CO. Isn't it their job to minimize those risks? Aren't we paying them for their service to minimize those risks? So by agreeing to transport the dogs, they have an obligation to you and the dog esp since they themselves promise certain things (no hotter than 85 degrees for 45 mins). For us passengers, they minimize our 'risk' by making sure that the planes are functioning properly, right? We can assume that if they see a faulty part on the plane, they'll fix it. If they didn't, wouldn't we call them negligent? And if, just if, something happens to you if you were on that plane. Do we say, oh well...that's the risk xyzzy took when he got on that plane.
