This will work even if you do have checked luggage, as you have to clear customs at EWR and claim/recheck your luggage there for the onward flight.

As far as future problems are concerned, if you do this kind of thing repeatedly the airline could come after you (or your travel agent) with a bill for what you actually flew vs. what you purchased. This almost never happens.
