Downgrade and Reimbursement according to Mennens Formula
I am flying BCN-YYZ-YQB in late May. I purchased my ticket with cash and in J in November. This week I was notified that my YYZ-YQB flight has had an equipment swap and is now a 737 without J.
As I am departing from Spain, Regulation EC261/2004 does apply. The Reg specifies that for downgrades on long-haul flights, the passenger is entitled to 75% of the fare of the downgraded segment. (This is known as the Mennens formula.) I would estimate this to be around EUR150?
The fact that the connection is outside the EU doesn’t matter because ECJ precedent has established that the whole BCN-YQB journey counts as one flight.
Does anyone know how I can go about and have AC reimburse me this? This applies to base fare and airline charges as well as any J-specific taxes. Any EC261 reference on AC’s website deals with delays or cancellations, not downgrades.
(Of course, I can also change my flight but I would depart earlier to YUL or arrive much later in YQB, hence I don’t want to go down this route.)
