I don't find the 3 hours you are talking about in the regulation. It was a flight < 1.500 km so it should be 2 hours.
LH says no compensation according to Art. 5 §1 (c) (iii) because I departed less than one hour before and arrived less than 2 hours after. That's also what they write on their website under Cancellation (

I say no, you have offered me re-routing, arriving 2 days later. I have booked the alternative flight arriving 1 hour later myself because you refused. So 250 EUR compensation.
