This policy was in practice 12/26/25 when we flew a 789 LAX-MIA. We were top of the business class upgrade list. Those did not clear but the GA called us to the podium and handed us 2 PE seats. Much to the consternation of another passenger who had been requesting those seats. I had been refreshing the seat map looking for PE seats as well. So it definitely seemed status based.
