The hotel has your credit card info and they're going to assess their charge. That's just the reality. It would be up to the guest to bring a challenge if they believe the charge is unwarranted, whether through a chargeback, a complaint to Marriott, or a small claims action.
OK so it's basically an unknown charge amount that is agreed to implicitly without being listed anywhere even indirectly in terms..
