I don’t know all the details of this case. If I had a stroke, heart attack or just died in flight I would hope that my survivor/estate would not be suing an airline just because it happened in the air. IMHO, responsibility begins and ends with my own self. I am my own keeper. However, I do know some certain things in life…lawyers and money. I would not be surprised if passengers need to sign a medical waiver form in the very near future.
