Nothing of what you quote applies to this situation. Each Gold member is entitled to a guest. So you are saying that if I am staying alone as a Gold member (and am fully entitled to a guest), a friend also staying at the hotel is ONLY allowed benefits if they sleep with me, but not if they happen to have their own room. It's absurd to suggest fraud when elite members are entitled to guests...
Security goes to rooms during the night all the time. A plumbing issue and the room before is flooding. Room below had a microwave fire and they are checking to make sure you are ok. If the person who is supposed to be there isn't there, it could be a problem.

And no you aren't entitled to a free breakfast for your friend sleeping elsewhere. The terms are clear

To lie and say it's 2 people in the room when they are staying elsewhere is fraud. Any time you feel the need to lie in order to get what you are owed, you aren't owed it
