I would presume it's probably not in the "spirit" of the rules, they're probably intending for same day connections in the morning from return flights from APAC or inbound from JFK/BOS-LAX in the evening.
That being said, you can certainly show them your D1 boarding pass that arrived the same day and try to get in.
Which D1 flight arrives at 12:05am though? Afaik all domestic D1 flights would be before midnight.
