That's true and affects what you would be charged if your only journey was from LHR into central London. But for capping purposes, the time of first journey is the relevant criterion..

There is no longer really a separate Anytime and Off Peak cap for zones 1-6. The price is the same for both- £16.30.
There is a separate Anytime (peak) and Off Peak cap for Gatwick Airport. The peak cap only of £40.90 applies if you touch in on a journey between 0630 and 0930. Journeys in the evening peak are charged at peak rates but count towards the off peak cap of £26.80.
Because of this you can save a heck of a lot of money if you travel in the morning peak by touching out at East Croydon then touching in again. In this case, simply by touching out and in again at East Croydon you could reduce your daily cap from £40.90 to as little as £20.40.
The time of touch in does affect the East Croydon to Gatwick Airport fare- it's £6.60 if you touch in from 0630 to 0930 or from 1600 to 1900, otherwise it is £4.10.
