Without that its just a ho hum card. My guess is that they will cap it shortly. BofA is pretty strict so my guess is that they will both cap it and also require in branch visits if you spend too much on foreign transactions to make sure you aren't living aboard etc.
gut feel, if BofA starts restricting it, they might do a quarterly cap, similar to the BoA Customized Cash card (pick one category to get 3% cash back + 75% bonus for being BofA Platinum Honors = 5.25% cash back + 2% (+ 75% = 3.5% cash back) on grocery stores and warehouse club -- they limit the cash back to $2500 combined per quarter)
