I don't see that the referenced case is relevant - In the referenced case, the initial flight was under the scope of EC261 and then connected onwards on a delayed flight . If that was the situation here, I would have agreed that the OP was entitled to compensation based on past cases , regardless of whether it was a codeshare flight ot not ( as per 2013 case of Folkerts vs AF )

In this case, the impacted flight is outside the scope of EC261
