On my EC261 claim filed last week, they got back with an excuse of "Air Traffic Control restrictions" which doesn't convince me, a DL flight took off 1 minute later on the JFK-FCO route and landed a full 33 minutes before we did.

Unfortunately, I suspect I may have to let it go as I'm not based in the EU and this case doesn't look so cut-and-dry.
