It will be interesting to see if airports in Washington are less strict about REAL ID as a result of this. If this affected me, I don't think I would feel comfortable carrying a foreign passport on every domestic trip. I would just give them my non-compliant ID and let them do the "identity verification process".
The legislature decided it, not DOL. It didn't fall through the cracks, it was a explicit policy decision that actually took several years of discussion and debate to be finalized.
I sincerely doubt TSA at Washington airports are going to less strict. Local media have been making a huge deal of the May 7 Real ID requirement and all indications are TSA is going to be on it. I don't think I'd like to be flying out of SEA this summer. Summer is already busy with cruise season and I think a lot of TSA personnel are going to be tied up with the "identity verification process" as even many people who are eligible for EDLs don't have them. I think it may well be a <redacted> at TSA checkpoints.
