overhead space is first come, first serve. the exception being F space is supposed to be for the F cabin. if it wasnt over your head it would be over someone elses.
Not to labor the point, but technically there are "MCE" bins for just those rows as well.
I think the biggest overall issue is people who are much farther back placing their bags in forward bins due to fear of not having a spot when they get to their row.
