Back when you were obsessed about being able to carry your special duffel bag onboard airplanes, you frequently employed this same logical structure in order to attempt to validate what you wanted to believe,... and, were told again and again and again and again, that there is no guarantee, no matter how you tweaked your phrasing.

In this case, the card present rule CAN be enforced anytime and anywhere. The odds of this may well be extremely low, but the fact it is possible means that you're stuck with this risk until you get your hands on the card.
