In this case the passenger was denied boarding from a flight that operated in order to accommodate passengers that had been long delayed as their flight had been cancelled because of a strike the day before. The judge ruled this was an IDB.

The judge ruled that extraordinary circumstances affecting a flight three rotations back did make the reason for the delayed flight extraordinary.
