I have spent a ton of time talking with AF. They don't seem to be fighting it and have sent my grievance to their customer service team. Will keep update about outcome.
So if AF was the operating carrier of the flight from MIA then you have a clear case for denied boarding under EU261. And the remedy will be money, something like €500-600 per person who presented correct documents but was denied boarding. There is no consideration for consequential costs, that's for you or your travel insurance.

The check-in agents should have called someone in China immigration, not France, for confirmation of your right to use TWOV.

Just in case you are not aware of some of the EU261 detail
  • Do not let AF cancel or refund your tickets. They can be changed . A cancelled and refunded ticket makes a compensation claim a lot harder as the contract has been ended.
  • Do whatever you need to do to enjoy your trip now but if you're building up new costs they will be for you or your insurer to pay for.
  • There is no rush to claim, you have up to 6 years.
  • I am not an EU261 expert but I know the basics. There might be better info in the AF forum, and I am sure I or others on here can guide you when you come to prepare and submit the claim.
