If the reason for denied boarding was that the traveller did not comply with the requirements for TWOV, with the itinerary suggested above that is perfectly valid. There is nothing in the rules that requires travel to be on the same itinerary.
If it was an AF operated flight out of MIA or any airline out of CDG where the denied boarding occurred the traveller has in my opinion a valid claim under EU261.
This was me and my family that got denied in MIA.State we needed a visa and would not budge. Even called someone in France, and he agreed. We were devastated as it was a very complex itinerary booked with points. it was miserable. We are flying around the world to all disney parks. Salvaged our plan, but currently have Shanghai cut out. Now planning to chop a day off HKG, fly HKG-PVG-NRT and spend one night in PVG the NRT the next day. I am so paranoid and traumatized. Will HKG give me any issue with this? Will be CX, and then not sure the other airline yet. Still rebuilding the itin. i hope HKG is more familiar with the 144 hour transit.
Ticket 2 was actually on CX for PVG-HKG. Then it was Delta miles but on china airlines for HKG-TPE-NRT.
I have spent a ton of time talking with AF. They don't seem to be fighting it and have sent my grievance to their customer service team. Will keep update about outcome.
