I have one in my garage I retired and it is way over 22" tall. The bigger issue is that if you use the side pockets it goes way over the limits. It is only a carry on when empty.

FYI, I received an email reply from Luggage Works saying that the 22-inch height "does include the wheels to the top of the handle."
