BA 'avoiding' upgrading my status when I have earnt it?

Good Morning,

On the 5th of November, I took a pair of flights from LHR-TLS-LHR in Business Class, in order to collect 80 tier points and upgrade my Executive Club Status from Bronze to Silver before the end of my collection year on November 9th. On the 8th of November, approximately 70 hours after the final flight in the booking had landed. I chased up BA via their customer support line to enquire when the Tier Points would be credited to my account. I was told that an investigation would be opened and I would receive word in 7-10 working days. On the 9th of November, my Tier Points were removes from my account, as expected at the end of the Collection Year. On Wednesday the 13th of November, I called again, as the booking had appeared on my account statement, but I had only received the Avios, and not the Tier Points. A quick Google search will show you that Avios and Tier Points should posted within 3 days of taking any flight, provided it was booked directly with BA, which it was. As the final flight landed at approximately 9pm local on the 5th, it would allow BA enough time to credit the avios and Tier points before my collection year ends. Even if BA was late crediting the flight to my account, because I flew within the collection year I should be entitled to a status upgrade. On the 21st of November, I was credited 560 Tier points due to "Tier Point Collection Year Change". This was the same amount of Tier points I had prior to taking the aforementioned flights with BA. On the 2nd of December, I received an email from customer relations, which stated the following:

"In this instance, your flights flown on 05 November were not credited to your account until 13 November. As your Tier Point collection year was reset on 9 November, the 80 Tier Points for these flights were credited straight into your Lifetime Tier Point balance.

Although we've adjusted the Tier Points on your account and these are for your previous Tier Point collection year, this does not affect your current tier status."

I believe that I have a legal case against BA here, as they have failed to credit the Tier Points in the time period stated on their website. And then despite reinstating my Tier points to align all collection years, still skipped over the points that should have been in my account almost a month ago.

I would appreciate some feedback on the situation and if anybody has any contacts within BA that could help me with this situation to avoid having to make me fork out for legal consultations etc.
