They don't get away with it. You take them to a court of law and they are forced to pay when they don't provide the information needed to prove their case. (they often don't even contest the claim in court)

Perhaps you didn't intend to book a LCC, but that's the standard procedure of all LCCs in Europe. (deny the claim initially, so that a certain % of people give up and don't bother taking their claims to court) There is also no shortage of FTers who have had to take the major mainline airlines - BA, Lufthansa, etc. - to court (and won) so it's just a fact of life with European air travel.
