As an general comment not specific to the OP’s case (who sounds like they live by the sword and were always going to end up in this kind of circumstance) but I’d imagine in an IDB case BA wouldn’t be in a particularly strong position to defend if they have a policy to record the gate closed time (which is the key timing point) but staff regularly can’t be bothered to do it.
Indeed, but I don't think it's a big factor since boarding passes also state when the gate closes, and I think the OP here concedes they were beyond that point. I can't see an IDB case working for purely that reason.
