EC261, and the UK's equivalent is a statutory right, if you are entitled to it, no-one can take it away from you, there is no discretionary component to it. The only way that CEDR could remove compensation would be if they were somehow to rule that BA misunderstood the law and make a payment by mistake. Now as you can probably appreciate this is an unlikely outcome, and I've not come across that happening. I guess they could - on Right to Care - say something wasn't necessary, whereas BA can be relatively generous in this space. Again I've not come across that. I
Okay, thanks for helping to ease my mind here.
I will decline BA's compensation offer and quoted their own legal guidance which gives the figure of £520.
I'll be sure to post any further updates here; I imagine it will be a little while as I believe the CEDR process can take some time.
