EC261, and the UK's equivalent is a statutory right, if you are entitled to it, no-one can take it away from you, there is no discretionary component to it. The only way that CEDR could remove compensation would be if they were somehow to rule that BA misunderstood the law and make a payment by mistake. Now as you can probably appreciate this is an unlikely outcome, and I've not come across that happening. I guess they could - on Right to Care - say something wasn't necessary, whereas BA can be relatively generous in this space. Again I've not come across that. I
