Yeah I'm thinking DL filed this basically as a thread and for leverage to negotiate a settlement in order to get more money out of CrowdStrike. Calculated risk, since I doubt DL wants all of their (likely very) dirty laundry coming out with regards to their IT infrastructure.
Its too late now for Delta with CrowdStrike filling a compliant in Federal District Court and exposing that Delta was not in compliance with the TSA cybersecurity emergency mandate. This will open up an other DOT investigation.

There must be a liquidated damages clause in the contract limiting CrowdStrike damages to $X for negligence. Or at the very least an ADR provision. No need to go to court.
Apparently it is was twice the annual subscription fee.
