because if that was the way, no drug ringleader or criminal getting others to do the dirty job could ever be caught? When someone acts on our behalf with out permission, their wrongdoing incriminates both themselves and us. That’s unfortunate for the op here but overall is a very necessary principle.

No, that’s not fraud at all, and if that was the only thing BA had found, the op would be enjoying their 295k avios right now. The alleged breaches will pertain to what was done with the account by the TA and which only the TA can explain.
