It's very clear that the 37M is accrued miles, not BIS miles.

But back onto topic, very sad if UA found a loophole to cancel Tom's pass. Not understanding why cancellation would be due to a disclosure when the pass had no disclosure restrictions.

But this just proves once again that it's never worth talking to the media about things like this. No good can possibly come out of it.
Technically speaking, they used to count miles from all sources. That ended in 2011 when they started counting BIS miles only. But, yeah, I don't believe the 37MM number is anywhere close to BIS miles and Tom is almost certainly top dog when it comes to BIS.
