Just came across this thread when researching the Indigo NYC Financial District. The Diamond breakfast benefit does not specify anymore that gratuity is included, see section "Welcome Amenity" on this page:

It seems US-based hotels won that one.
Not all of them, the Kimpton Monaco Denver had Diamond elite vouchers that specifically stated that sales tax and a 20% gratuity was included.
Was not presented with a bill which is the way it should work (you can always leave something extra anyway) but I agree it is not the case everywhere, especially in the US
