Yes, pursue it with the DOT. They've made it clear that the US Government does believe it's within DL's control.
The DOT complaint form is easy to fill out. If you win, you're up a lot of money. If you lose, you can still go to the EU and complain... and they've taken a similar stance as the DOT for what's in an airline's control.
We're going to always be treated like garbage by the companies we do business with unless people push back and have their voices heard. The initial DL customer facing response was completely unacceptable as was their overall recovery. The law is clear about what passengers deserve --go get it!
I was at the conference when he said this, then had a chance to ask him about it, right before he resigned and went to ... Apple.
