Not only that:
1 - you remove your wife/partner - you have to wait 6 months before you can set up a new pool with him
2 - he removes his family members (basically best to do it at the same time as you do, so his period of 6 months runs concurrent to yours)
3 - after 6 months, you create your pool, invite him, do whatever you have to do, and disband the new pool
4 - both of you have to wait ANOTHER 6 months to re-establish your original pools
You mention that he is sitting on 300k miles. Is it in his account or is it combined value of pool members? If it is combined and you follow the above, you will only have access to his share of the pool, not all of it, and, as @oliver2002 already said, this "cooling-off" periods were established to prevent this sort of operations and while not illegal, they may trigger audit, and be aware that "buying" his miles is against program's rules.
