Not so sure I'd accept that as fact...
People doing (or saying) things which cause others offence are likely to find themselves on the wrong side of Mr Plod these days...witness the soccer fan up in court for making 'monkey signs' to a black player!
If people kissing offends other people I suspect were there a desire to prosecute some law would be found to enable it...and if there is a lack of will to prosecute (hunting bill anyone?) then for some reason there is difficulty in defining just which law has been broken...
