Then the Q arises; which airline do you claim comp. from in this situation? Surely, the non-EU airline will reject liability/to be subject to EU Reg. 261/04 as it is not a community carrier and the relevant flight was outside the EU. And the community carrier will reject liability stating that pax need to claim from the airline performning/operating the relevant flight (which is also correct). I don't see any airline paying up voluntarily in the situation you describe.
