I strongly disagree with this!
The "By the book" response is a no, so any sane person responding from the hotel will respond as "no".
If that gets into your record and then you ask again, maybe it comes back "no" again.
As the next response noted, the best way is to be pleasant and polite at check in and typically, in my experience, you end up getting the free breakfast, but asking the hotel to put in writing a violation of company policy probably isn't the best idea.
