To flush below a certain altitude, a vacuum generator is used. If this is not working, the aircraft must be at a sufficient altitude for the pressure differential to suffice. The vacuum generator is not a MEL item, so the aircraft can fly - albeit with limitations.
MEL = Minimum Equipment List. Not everyone knows every acronym.
